Acceptance of Terms
By creating an account, browsing listings, or completing a rental on Borrow, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our platform.
Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use Borrow. By registering, you confirm that you meet these requirements. Users under 18 are not permitted to create accounts or participate in rentals.
Your Account
You are responsible for maintaining the accuracy of your account information and keeping your password secure. You agree not to share your account credentials with others. You are fully responsible for all activity that occurs under your account. Notify us immediately at contact@getborrow.app if you suspect unauthorized access.
Rentals & Listings
Lenders are responsible for accurately describing their items, setting fair prices, and making items available as scheduled. Borrowers are responsible for using items with reasonable care, returning them on time in the condition received, and following any usage instructions provided by the lender. Both parties agree to use the QR check-in system to document item condition at pickup and return.
Payments & Fees
Renters pay the rental subtotal plus a disclosed 5% renter service fee. Borrow deducts an owner platform fee of 10% for Standard, 8% for Preferred, or 6% for Elite owners, with a $1.50 minimum at every tier, before calculating the owner payout. The deposit is a separate authorization and is excluded from both fee calculations. Borrow bears ordinary Stripe card-processing costs. Standard owner payouts are free; if an owner elects instant payout, the applicable Stripe instant-payout cost is disclosed and passed to that owner. With your express permission, Borrow saves a card and may place a separate temporary security authorization shortly before pickup. Cash payments outside the platform are prohibited.
Security Authorization & Claims
The security authorization is not insurance and does not guarantee owner reimbursement. Owners must report an eligible problem within 24 hours of return and provide timestamped photographs plus repair, receipt, or replacement evidence. Renters may respond. Borrow alone approves, reduces, or rejects a claim and may capture only the documented approved amount, never more than the authorization, verified repair cost, or current replacement value. Ordinary wear, preexisting damage, unexplained mechanical failure, owner dissatisfaction, and undisclosed fees are excluded. Have this authorization language reviewed by counsel before launch.
Prohibited Conduct
You may not use Borrow to list illegal items, engage in fraudulent activity, harass other users, circumvent the payment system, misuse items in a way that endangers others, or violate any applicable laws. Violations may result in account suspension, approved recovery from an active security authorization, and legal action.
Disclaimers & Limitation of Liability
Borrow provides a platform connecting borrowers and lenders. We are not a party to rental agreements between users. We do not guarantee the condition, availability, or suitability of any listed item. To the maximum extent permitted by law, Borrow is not liable for indirect, incidental, or consequential damages arising from your use of the platform.
Account Suspension & Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to our community. You may request account deletion at any time, but all items must be returned and outstanding balances, claims, refunds, security authorizations, and payouts must be resolved first. Eligible requests enter a seven-day security hold before the account and deletable personal data are removed. Transaction, identity-linkage, fraud-prevention, tax, and dispute records may be retained where reasonably necessary or legally required.
Changes to These Terms
We may update these Terms of Service periodically. Significant changes will be communicated through the app or via email. The "Last updated" date below reflects the most recent revision. Continued use of Borrow after changes constitutes acceptance of the updated terms.
